What you need to know
A tenant can be anyone who is in hired accommodation, or is seeking accommodation - including accommodation provided by hotels and motels.
As a tenant, you have the right to be treated the same as any other tenant irrespective of your age, association with a child, caring responsibilities, chosen gender, disability, marital or domestic partnership status, pregnancy, race, sex, sexuality, or spouse or partner’s identity. It is also against the law to sexually harass or victimise a tenant.
There are some situations where it is acceptable to treat someone differently based on one of the personal characteristics listed above.
What you can do
If you think you have been discriminated against based on one of the above personal characteristics, you may be eligible to lodge a complaint under the Equal Opportunity Act. However, sometimes taking action can solve the problem.
Here are some things you can do:
- Ask for reasons why you weren't successful in getting the accommodation.
- Depending on the situation, you could talk to the provider of the accommodation or the manager of the business or organisation about the situation.
- If this doesn't work you can contact us and talk to an advisor. It may be that you can lodge a complaint.
