Labour hire agencies
Labour hire agencies, also known as temp agencies, employ people to work at other places.
This means that:
- the labour hire agency is your employer
- your workplace is the client of the labour hire agency.
The agency will not directly supervise your work or control your workplace. However, they are still responsible as your employer and may occasionally monitor your workplace.
Both the workplace and the labour hire agency are responsible for your safety at work and for making sure the workplace is free from discrimination and harassment – and both can be responsible if discrimination happens.
A labour hire agency found Kate a job at a doctor's surgery. She told the agency she was being sexually harassed so they found her another job elsewhere. However, the agency kept a file about harassment problems raised by other staff who had been placed with the same employer, but did nothing. Both the doctor's surgery and agency were liable.
