Shop owners and service providers are not only responsible for their own behaviour but under certain circumstances they are also responsible for their staff's behaviour. This is known as vicarious liability.
If staff unlawfully discriminates or harasses another staff member or a customer, a business can be held responsible. Owners could be liable unless it can be shown that reasonable steps have been taken to prevent discrimination or harassment.
Vicarious liability covers discrimination or harassment in all business dealings with customers and clients, potential customers and clients, and other businesses.
