Equal opportunity law is like any law which affects your business. There are legal obligations.
You are legally bound to take action to prevent discrimination, harassment or victimisation in your business and to address these behaviours effectively if they occur.
Knowing about the law is easy and makes good business sense. Not knowing could cost you a lot in time, money and reputation.
What you can do
Whether your business is big or small, the law says you must take reasonable steps to prevent discrimination and harassment and to address these behaviours effectively if they occur.
What is reasonable for a large corporation may not be reasonable for a small business.
To start with, you should understand your responsibilities and respond with a stated policy and complaint procedure.
- Have a policy which rules out discrimination and harassment.
- Tell your customers and employees about it regularly.
- Have a procedure to deal with complaints.
- Know how to handle complaints quickly, fairly and confidentially.
- Treat customers and employees fairly in your dealings with them.
- Consider making an employee an Equal Opportunity contact person.
- Monitor and maintain a culture of Equal Opportunity.
If an organisation is unable to show that it took all reasonable steps, it may be held legally responsible for the actions of its employees.
